The Allahabad High Court has clarified the legal framework surrounding religious prayers on private property in a ruling dated April 6. The court stated that while occasional prayers can be held without disruption, regular and organized activities could necessitate government oversight. This decision came in response to a writ petition from Aseen, a resident of Sambhal district in Uttar Pradesh, who sought permission to conduct large-scale congregational prayers on his private land, claiming ownership through a gift deed from June 2023. The court noted that traditional practices, such as offering namaz only during Eid, could continue without restriction. However, it highlighted that introducing new, regular practices that disturb social balance is not protected under the Constitution's provisions for religious freedom. The bench, comprising Justice Saral Srivastava and Justice Garima Prashad, emphasized that the state has the authority to prevent disruptions to public order and that the right to practice religion must not infringe upon the rights of others.
