The Allahabad High Court has affirmed the land acquisition process for the expansion of the Noida International Airport in Jewar, located in Gautam Buddha Nagar district, Uttar Pradesh, India. In an order dated April 28, the court directed that all rehabilitation measures must be completed prior to taking possession of residential land. The ruling came after petitions from villager Vijay Pal Singh and 12 other farmers challenged the acquisition process for Phases II and III of the airport project, citing violations of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and infringement of property rights under Article 300A of the Indian Constitution. However, the court found that the acquisition adhered to the 2013 law, including social impact assessments, public hearings, and compensation requirements. The court noted that the petitioners did not contest the acquisition of agricultural land but expressed concerns over the displacement of residential areas. It emphasized that individual property rights must be balanced against public interest, particularly in infrastructure projects. The court mandated that the rehabilitation and resettlement scheme be strictly implemented during the airport expansion, and possession of residential land should only occur after all rehabilitation measures, including the allotment of developed plots, are completed.
