The U.S. Court of International Trade has set May 11, 2023, as the expected date for the first tariff refunds following a Supreme Court ruling that declared the tariffs imposed by former President Donald Trump illegal. Approximately 21% of entries under the International Emergency Economic Powers Act (IEEPA) have been accepted for the removal of duties through a new process called the Consolidated Administration and Processing of Entries (CAPE). As of April 26, about 1.74 million accepted entries have been liquidated and are in the refund process, which includes payments from the U.S. Treasury. The refund process could potentially cover $166 billion in duties paid by over 330,000 importers on roughly 53 million entries. Following the Supreme Court's decision on February 20, which ruled that Trump lacked the authority to impose these tariffs, he criticized the ruling and subsequently imposed a new 10% global tariff.
