On Wednesday, a Delhi court granted bail to Neelam Singh, a social media influencer known as 'The Skin Doctor', following his arrest for allegedly posting objectionable content about the family of businessman Sunjay Kapur. Judicial Magistrate First Class Snehil Sharma noted that Singh's post did not exhibit criminal intent, stating, 'There is no mens rea in the act of the accused and no criminality emerges from the said tweet.' Singh was arrested after Priya Kapur, the wife of the late Sunjay Kapur, filed a complaint at the Vasant Kunj Police Station, claiming that Singh's post was defamatory and based on manipulated court records. The police had filed a first information report (FIR) citing sections of the Bharatiya Nyaya Sanhita (BNS) related to theft and defamation, along with relevant sections of the Information Technology (IT) Act. The court referred to the Arnesh Kumar guidelines, which aim to prevent unnecessary detention for offenses punishable by less than seven years. The judge highlighted that Singh had cooperated with the investigation and did not require further custody.
