Terms and Conditions of Use

1. Capitalized terms, not defined elsewhere in this Agreement, shall mean as follows:

• “App” means the SAMACHAAR.AI software application and/or web-based platform, including its app-like or progressive web application (PWA) experience, which may be accessed through mobile devices, desktops, or other supported devices via the SAMACHAAR.AI website or scan-based instant access interface, and includes any updates, enhancements, or modifications thereto made available by Us from time to time.
• “App Store” means the service operated by Apple Inc. and/or its affiliates, acting as a third-party platform through which You may optionally download or access applications, including the SAMACHAAR.AI App where applicable.
• “App Store Terms and Conditions” means the terms and conditions governing the use of the App Store platform, as made available at: apple.com/legal/internet-services/itunes/us/terms.html, as amended from time to time by Apple Inc.
• “Google Play” means the digital distribution service operated by Google Ireland Limited and/or its affiliates, acting as a third-party platform through which You may optionally download or access applications, including the SAMACHAAR.AI App where applicable.
• “Google Play Terms of Service” means the terms of service governing the use of Google Play, available at: play.google.com/about/play-terms.html, as amended from time to time by Google.
• “Sponsored Content” means any content displayed on the App that is distinct from regular AI-generated or aggregated informational content, including but not limited to audio, video, text, or image-based material that promotes, supports, or references a third-party brand, product, or service. Sponsored Content will be clearly distinguishable from regular content through labels, design markers, or disclaimers such as “Ad”, “Sponsored”, “Promoted”, “Powered by”, or similar identifiers.
• “User” or “You” or “Your” refers to any natural person or legal entity that accesses, browses, or uses the App or Services in any manner, whether or not such person has created an account or completed a formal registration process.

2. Any reference to the singular includes a reference to the plural and vice versa, and any reference to one gender includes a reference to other gender(s), unless explicitly provided for.

3. Headings and captions are used for convenience only and not for interpretation of the Agreement.

4. Any reference to a natural person shall include his/her heirs, executors and permitted assignees and any reference to a juristic person shall include its affiliates, successors and permitted assignees, unless repugnant to the context.

You agree to and accept these Terms of Service (“Agreement”) by accessing, browsing, or using the SAMACHAAR.AI website or application services from any device, including but not limited to visiting our website, interacting with our web platform, or accessing the application through any supported access method provided by the Company, including the scan-based instant access feature described below.

2. SAMACHAAR.AI is accessible primarily through a web-based platform that may also provide instant application access experience. When you visit our website on a mobile device or computer, you may be shown a scan or quick access interface that allows you to instantly open or access the SAMACHAAR.AI application experience, where the SAMACHAAR.AI app icon or interface may appear directly on your device for ease of use, without requiring download from any third-party application store.

You may accept these Terms only if:

• You are a natural person who has attained the legal age of majority in your jurisdiction and is of sound mind and capable of entering into a binding agreement with SAMACHAAR.AI in relation to your use of the Services; or
• You are a legally incorporated or validly existing juristic entity that has all necessary rights, authorizations, and approvals to enter into this Agreement and be bound by its terms; and
• You are not prohibited or restricted under applicable laws from accessing or using the Services.

3. You acknowledge and understand that SAMACHAAR.AI intends users to carefully read and understand this Agreement and the Privacy Policy before using the Services. If you do not understand, agree with, or accept these Terms in their entirety, you are advised not to access or use the Services in any form.

4. By continuing to access or use SAMACHAAR.AI, you confirm your acceptance of this Agreement and agree to be legally bound by its terms.

1. SAMACHAAR.AI provides an AI-assisted news aggregation and summarization platform through an embedded in-app browsing experience. The App brings together third-party news content in a simplified, summarized format within a single interface to help users quickly discover and access information relevant to their interests. The App does not create, originate, or independently publish news content. Unless explicitly stated otherwise, SAMACHAAR.AI does not host, store, or transmit third-party content on its own servers except where it has obtained necessary rights, licenses, or is otherwise permitted under applicable law. Each summary may include a reference link directing users to the original source. By choosing to access such external links, you acknowledge that you are leaving the SAMACHAAR.AI platform and that any interaction with third-party websites is governed solely by their respective terms and policies. SAMACHAAR.AI shall not be responsible or liable for any loss, data breach, or damage arising from your use of external websites or third-party content. You further acknowledge that SAMACHAAR.AI functions as an intermediary technology platform that facilitates access to aggregated information and does not claim ownership or editorial control over third-party content or its accuracy.

2. The App may contain links, references, or automated suggestions to third-party websites or mobile applications, including results generated through algorithmic or AI-based systems. Such links may include content that is third-party owned, user-generated, or externally sourced and may occasionally include material that is inaccurate, outdated, or objectionable. SAMACHAAR.AI does not endorse, verify, or assume responsibility for any third-party content, services, or offerings accessed through such links, which are provided solely for user convenience.

3. In order to access and use certain features of the App, you may be required to register as a user by providing certain information, which shall be governed by our Privacy Policy.

4. You acknowledge and agree that the App may display sponsored content, promotional material, or paid placements, which may appear within or alongside regular content feeds. Such content will be clearly marked where applicable.

5. By using the App, you represent and agree that:

• All information provided by you is true, accurate, current, and complete to the best of your knowledge;
• You will use the App solely for personal and non-commercial purposes unless expressly permitted otherwise;
• You will not use the App or its content for any unlawful, prohibited, or unauthorized purpose;
• You will not copy, reproduce, modify, distribute, create derivative works from, or publicly display any content from the App without prior written permission, except as permitted under applicable law; and
• You will not assign, transfer, or sublicense your rights under this Agreement to any third party.

6. If you are a content provider or your content appears through links or references on the App, you agree to comply with applicable laws and may be required to provide relevant information to lawful government or regulatory authorities, including details related to your account or published content, as required under applicable law.

7. You acknowledge that SAMACHAAR.AI shall not be responsible for the accuracy, completeness, or authenticity of any information that may be disclosed by you or any third party in response to lawful requests made by government or regulatory authorities.

8. SAMACHAAR.AI reserves the right, at its sole discretion, to modify, suspend, or discontinue the App (or any part thereof), temporarily or permanently, with or without notice. We may also update or modify these Terms from time to time. Continued use of the App after any such changes shall constitute your acceptance of the updated Terms.

By participating in any polls, surveys, or voting features (“SAMACHAAR.AI VYBE”) on SAMACHAAR.AI, you agree that these terms apply to all users, whether you have created an account and provided personal information or are accessing the platform without registration, and that such participation is entirely voluntary. The VYBE features are conducted solely to understand general user sentiment and opinion trends, analyze how news content may influence public perception, and improve the quality, relevance, and presentation of news and information on the platform. All responses collected through these features are used only for aggregated insights and research-oriented analysis, and SAMACHAAR.AI does not disclose or publish how any individual user has voted or responded.

Any data collected, including personal data where applicable, is processed using anonymization and/or pseudonymization techniques so that it cannot reasonably be used to identify any individual, and all results that may be published, shared, or displayed will be presented strictly in summarized and aggregated formats such as percentages, trends, or insights without including any personally identifiable information. SAMACHAAR.AI implements reasonable technical and organizational measures to ensure that polling responses are handled securely and responsibly, and such data may be used internally to enhance AI-driven features, improve personalization, and better understand audience engagement in line with the platform’s objective of delivering “Your Voice, Your News.”

SAMACHAAR.AI reserves the right to update or modify these terms at any time, and continued participation in any Polling Features shall constitute acceptance of such updates; users who have questions regarding these terms or data usage practices may contact the platform through its official support channels.

1. A violation of any provisions of this Agreement may result in a legal liability upon You and that nothing in these Agreement should be construed to confer any rights to any third party. You are responsible for Your conduct and activities while using the App, and for any consequences thereof.

2. If any provision of the Agreement is found to be unenforceable under the applicable law, it will not affect the validity and enforceability of the other provisions of this Agreement. Such unenforceable provision shall be deemed superseded by a valid enforceable provision that most closely matches the intent of the original provision.

3. We may choose to not act with respect to a breach of this Agreement by You or others but this does not preclude our legal right against You with respect to subsequent similar breaches. Our failure to exercise or enforce any provision of this Agreement shall not constitute a waiver of such right or provision.

1. SAMACHAAR.AI is primarily a web-based platform that may provide an app-like experience through supported access methods, including scan-based instant access from the website on mobile or desktop devices. You are responsible for ensuring that you access the latest version of the platform experience as may be made available by us from time to time, including updates, improvements, or feature enhancements necessary for continued access and optimal performance of the Services.

2. You agree to use the App and/or Services only for purposes permitted under this Agreement and in compliance with applicable laws, regulations, and generally accepted practices or guidelines in the jurisdiction from which you access or use SAMACHAAR.AI.

3. If you create, submit, or generate any content through or in connection with the App (including feedback, inputs, or user-generated interactions), you grant SAMACHAAR.AI a limited, non-exclusive, worldwide, royalty-free, transferable and sublicensable license to use, store, process, reproduce, and display such content solely for the purpose of operating, improving, and providing the Services, including under this Agreement, our Privacy Policy, and any applicable content or platform policies.

4. SAMACHAAR.AI grants you a limited, non-exclusive, non-transferable right to access and use the Services for personal and lawful purposes through compatible devices and supported access methods. You may not copy, modify, reverse engineer, decompile, or create derivative works of any part of the App or Services, except where such restriction is not permitted under applicable law, in which case such use shall be limited to the extent permitted.

5. SAMACHAAR.AI grants you a non-exclusive, non-transferable right to access platform-owned content made available through the Services strictly for personal and non-commercial use. All third-party content displayed, summarized, or linked through the App remains the property of respective third-party rights holders. SAMACHAAR.AI does not grant you any license or rights in such third-party content, and your access to such content is governed solely by the applicable terms of the respective third-party source. Any use of third-party content outside the platform is subject to the rights and permissions granted directly by such third party.

1. You agree and acknowledge that You will not host, display, upload, modify, publish, transmit, update or share any information that:

• belongs to another person and to which the User does not have any right;
• is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy, including bodily privacy, insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws in force;
• is harmful to a child;
• infringes any patent, trademark, copyright or other proprietary rights;
• violates any law for the time being in force;
• deceives or misleads the addressee about the origin of the message or knowingly or intentionally communicates any information which is patently false or misleading in nature but may reasonably be perceived as a fact;
• impersonates another person;
• threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting other nation;
• contains software viruses or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
• is patently false and untrue, and is written or published in any form, with the intent of misleading or harassing a person, entity or agency for financial gain or to cause any injury to any person; or
• is in the nature of any material which exposes the private area of such individual, shows such individual in full or partial nudity or shows or depicts such individual in any sexual act or conduct, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual.

2. You will not access (or attempt to access) the content provided through the App by any means other than through the App, unless You have been specifically allowed to do so in a separate written agreement with SAMACHAAR.AI.

3. You will not redistribute, sublicense, rent, publish, sell, assign, lease, market, transfer, or otherwise make the App or any component or content thereof, available to third parties.

4. You will not circumvent or disable any digital rights management, usage rules, or other security features of App; remove, alter, or obscure any proprietary notices (including copyright notices) on any portion of the App; and not use the App in a manner that threatens the integrity, performance, or availability of the App.

5. You will not attempt to or engage in any activity that may:

• reverse engineer, decompile or otherwise extract the source code related to the App or any part thereof, unless it is expressly permitted by SAMACHAAR.AI to You in writing or is required by the applicable law;
• use any robot, spider, retrieval application, or other device to retrieve or index any portion of the App or content thereof;
• collect information about users of the App for any illegal or unlawful purpose;
• create any user accounts by automated means or under false or fraudulent pretenses for using the App;
• transmit any viruses, worms, defects, trojan horses, or any items of a destructive nature through the App;
• use the App in any manner that could damage, disable, overburden, or impair, or undertake any action which is harmful or potentially harmful to, any of the servers, networks, computer systems or resources connected to any of the servers connected, directly or indirectly to the App, or interfere with any other Users’ use and enjoyment of the App;
• carry out any denial of service (DoS, DDoS) or any other harmful attacks on the App; disrupt or place unreasonable burdens or excessive loads on, or interfere with or attempt to make, or attempt any unauthorized access to the App or any part of the App or any user of the App;
• forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the App; or obtain any materials or information through any means not intentionally made available, in the opinion of SAMACHAAR.AI, through the App.

6. You will not impersonate another person or impersonate, guide or host on behalf of, or falsely state or otherwise misrepresent Your affiliation with any person or entity, including, but not limited to Our officials, employees, agents, partners, affiliates, dealers and franchisees.

1. You can report any violation of these Terms by writing to Mr. Prakhar Yadav, Grievance Officer at legal@samachaar.info and we will endeavor to address Your concern within 15 days.

2. If You find any content on the App which falls under any of the prohibited categories of content listed in section G(1) above, You can inform us of such a violation of these Terms by writing to Us at legal@samachaar.info with:

• a screenshot or sharing the link of the infringing post; and
• Your reasons for objecting to such content.

3. Your reports of violation of these Terms will be received and acknowledged within 24 hours by Our Grievance Officer.

4. We will respond to Your reports of violations no later than 15 days by:

• Taking down such violating content; or
• Suspending/blocking of the violating user’s account; or
• Terminating of the violating users’ access to the App.

5. We will respond with the above actions within 24 hours if Your reports relate to violation of section G(1)(k) of these Terms.

6. Our Team’s assessment of any complaints relating to content shared on the App will be limited to whether such content violates these Terms or Our own internal policies and guidelines. Such a decision will be final and binding as regards content on the App. We do not undertake any legal analysis or judgement on the nature of reported content. If You have any objections against any action taken by Us pursuant to clause G(4) above, You can inform us of Your reasons for such objections by writing to Us at legal@samachaar.info.

7. We will review Your objections, and reserve the right to modify/retain our decision on any complaint against content shared on the App.

1. Your access to the App may be terminated if:

• You voluntarily uninstall the App from Your device;
• You knowingly or unknowingly cause direct or indirect breach, as ascertained by SAMACHAAR.AI, of this Agreement as a whole or in part or any applicable laws;
• We are required to do so by law (for example, where the access to and/or provision of the App to You becomes unlawful);
• The third party, if any, with whom We offered the App to You has terminated its relationship with Us or ceased to offer the related services to Us or to You;
• The provision of App to You is no longer commercially viable or feasible for Us; or
• SAMACHAAR.AI may terminate Your usage of the App at any time, with or without notice and may procure disabling Your access to the App and/or barring You from any future use of the App.

2. You may terminate your agreement with SAMACHAAR.AI at any time by terminating Your access to the App. However, your certain obligations under this Agreement shall continue to prevail even on such termination.

3. When your agreement with SAMACHAAR.AI comes to an end, all of the legal rights, obligations and liabilities that You and SAMACHAAR.AI have benefited from arising out of or in connection with this Agreement, or which are expressed to continue indefinitely, shall be unaffected by this cessation, and shall continue to apply to such rights, obligations and liabilities indefinitely.

1. Your use of the App is, and at all times shall be, governed by and subject to the laws regarding copyright, trademark, patent, and trade secret ownership and use of intellectual property. You agree to abide by laws regarding copyright, trademark, patent, and trade secret ownership and use of intellectual property, and You shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by Your use of the App through Your device.

2. SAMACHAAR.AI owns and retains all the intellectual property rights to the summarized content made available to You through the App by SAMACHAAR.AI but does not claim ownership rights to the original sources of information, which are instead held by the sites to which the App may link You.

3. All trademarks, brands and service marks of the App are the property of SAMACHAAR.AI only. SAMACHAAR.AI owns all of the copyrights and database in relation to the App. The content included on this website, including, but not limited to the SAMACHAAR.AI tests, reports, text, graphics, logos, icons, and images is the exclusive property of SAMACHAAR.AI and other respective owners that have granted SAMACHAAR.AI the right and license to use such property and is protected by Indian and international copyright laws. All trademarks, service marks, and trade names are proprietary to SAMACHAAR.AI or other respective owners that have granted SAMACHAAR.AI the right and license to use such marks.

4. The App and any underlying technology or software used in connection with the App may contain rights of SAMACHAAR.AI or its affiliates or any third party. For use of any third party’s intellectual property, You may need to get permission directly from the owner of the intellectual property.

5. Any intellectual property which is not specifically mentioned to be owned by SAMACHAAR.AI is owned by their respective owners and the owners have a right to take appropriate actions against You for any violation, infringement or passing off.

6. SAMACHAAR.AI respects the intellectual property rights of others and does not hold any responsibility for any violations of any intellectual property rights by You.

1. Our Privacy Policy explains how We treat Your personal data and protect Your privacy when You use the App. By using the App, You agree that We can use such data according to Privacy Policy.

2. You are responsible for maintaining the confidentiality of passwords associated with any device You use to access the App. Accordingly, You are solely responsible for all activities that occur with Your device. If You become aware of any unauthorized use of Your device, You will notify the relevant authorities as soon as possible.

1. Your use of the App or any content available thereof is entirely at Your own risk and We shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, monetary or any other damages, fees, fines, penalties or liabilities whatsoever arising out of or relating to Your use of the App.

2. You may terminate Your access to the App if You are not satisfied with the App.

3. You shall defend, indemnify and hold SAMACHAAR.AI, and its officers, directors, employees, representatives and agents harmless from and against any claims, actions, demands, liabilities, judgments, and settlements, including without limitation, reasonable legal fee that may result from or alleged to result from:

• Your use of the App; or
• Your breach of any rules, regulations and/or orders under any applicable law.

4. You are also responsible for any breach of Your obligations under the Agreement and/or for the consequences of any such breach.

1. We shall make our best efforts to make the App available to You in the best possible manner. However, We disclaim all warranties in relation to the App, whether express or implied, including but not limited to:

• the App being constantly available or available at all;
• installation or un-installation choices in relation to the App being successfully executed in all cases;
• that App will always function without disruptions, delay or errors;
• Your personal ability to use the App;
• Your satisfaction with the use of the App;
• the accuracy of the data provided by the App;
• the security and privacy of Your data;
• that all bugs or errors in relation to the App will be corrected;
• that the App will be compatible with all devices and all networks;
• that the App is fit for a particular purpose or use; or
• that the App and the contents thereof are accessible in every location.

2. SAMACHAAR.AI, its officers, directors, employees, affiliates and agents and any other service provider responsible for providing access to the App in connection with this Agreement will not be liable for any acts or omissions, including of a third party, and including those vendors participating in SAMACHAAR.AI’ offerings made to You, or for any unauthorized interception of data or breaches of this Agreement attributable in part to the acts or omissions of third parties, or for damages associated with SAMACHAAR.AI, or equipment that it does not furnish, or for damages that result from the operation systems, equipment, facilities or services provided by third parties that are interconnected with SAMACHAAR.AI.

1. The App may be controlled and operated through any country and may be subject to the laws of that country in which they are controlled and operated. If You use the App from any location, then, You are responsible for compliance with the local laws applicable to You.

2. This Agreement shall be governed by and shall be construed in accordance with the laws of India.

3. In the event of any dispute, difference, or claim arising out of or in connection with this Agreement (“Dispute”) between You and Us, the parties shall first attempt to resolve such Dispute amicably through good faith negotiations. If the Dispute is not resolved within 30 (thirty) days from the date on which either party notifies the other party in writing regarding the existence of such Dispute, then either party shall have the right to refer the Dispute to arbitration by issuing a written notice (“Arbitration Notice”) to the other party.

4. Upon issuance of the Arbitration Notice, the Dispute shall be referred to and finally resolved by a panel of three (3) arbitrators, with each party appointing one arbitrator and the two appointed arbitrators jointly appointing the third and presiding arbitrator. In the event that a party fails to appoint its arbitrator within 30 (thirty) days of receipt of the Arbitration Notice, or if the two appointed arbitrators fail to agree on the presiding arbitrator within 30 (thirty) days of their appointment, such appointment(s) shall be made in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

5. The seat and venue of arbitration shall be Gurugram, Haryana, India. The arbitration proceedings shall be conducted in the English language and shall be governed by the Arbitration and Conciliation Act, 1996. The arbitral award shall be final and binding on the parties. Subject to the arbitration clause above, the courts at Gurugram, Haryana, India shall have exclusive jurisdiction for the purposes of interim relief, enforcement of arbitral awards, or any matters arising in relation to the arbitration proceedings. Prior to or pending arbitration, nothing in this Agreement shall preclude either You or Us from seeking an interim or injunctive relief from courts of competent jurisdiction.

6. You and SAMACHAAR.AI agree that any cause of action arising out of Your use of the App must commence within 3 (three) months after the cause of action accrues or You become aware of the facts giving rise to the cause of action, whichever is later. Otherwise, such cause of action shall be permanently barred.

1. SAMACHAAR.AI may post notices within the App or send You notices on Your registered e-mail address or the telephone number. You will have been deemed to have received such notices within 3 (three) days of Us sending the notice. Your continued use of the App on expiry of such 3 (three) days shall constitute Your receipt and acceptance of the notices sent to You.

1. The contents provided through the App may include technical inaccuracies or typographical errors. SAMACHAAR.AI may make changes or improvements to the App at any time. The contents or any information available on the App is provided “as is” and “as available” and without warranties of any kind either expressed or implied, to the fullest extent permissible pursuant to applicable law. SAMACHAAR.AI does not warrant that the functions contained in the contents will be uninterrupted or error-free, that defects will be corrected, or the servers that make them available are free of viruses or other harmful components. SAMACHAAR.AI makes no commitment to update the materials on the interface. The above exclusion may not apply to You, to the extent that applicable law may not allow the exclusion of implied warranties. SAMACHAAR.AI shall not be liable for any misuse or data theft as a consequence of Your use of the App.

2. You expressly represent and warrant that you will not use the App if you do not understand, agree to become a party to, and abide by all the terms specified in this Agreement. Any violation of this Agreement may result in legal liability upon you. Nothing in the Agreement should be construed to confer any rights to any third party or any other person.

Your correspondence or business dealings with, or participation in promotions of, Sponsored Content or activity providers found on or through the App, including payment and delivery of related products or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between You and such provider of Sponsored Content. We will not be responsible nor liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such Sponsored Content on the App.
