In a landmark ruling, a special POCSO (Protection of Children from Sexual Offences) court in Yupia, Arunachal Pradesh, sentenced Lakang Tallang, a 44-year-old man, to death for the repeated rape of his minor relative in 2019. The court, presided over by Special Judge Dr. Hirendra Kashyap, described the case as a 'rarest of rare' instance involving a grave breach of trust, as Tallang was the victim's maternal uncle. The incident occurred on June 4, 2019, when Tallang allegedly diverted a vehicle to an isolated area, threatened the victim with a machete, and assaulted her. The court found the victim's testimony credible, supported by medical and forensic evidence, including injuries consistent with sexual assault. Given Tallang's status as a repeat offender, previously sentenced to life imprisonment in another POCSO case, the court deemed life imprisonment insufficient. It imposed a fine of ₹1 lakh (roughly $1,200 USD) and referred the case to the Gauhati High Court for confirmation of the death sentence. The court also directed the district legal services authority to ensure the victim receives adequate compensation under the Arunachal Pradesh Victim’s Compensation Act, 2011.
