On Tuesday, the Supreme Court of India proposed the creation of guidelines to regulate the use of artificial intelligence (AI) in the legal system, particularly in drafting judgments and filing petitions. This move is in response to recent incidents where court orders from a trial court in Andhra Pradesh and the National Company Law Tribunal (NCLT) in Mumbai included 'fake' or 'hallucinated' case citations, raising concerns about the integrity of judicial proceedings. Justices PS Narasimha and Alok Aradhe stressed the need for control over the information submitted to the court, stating that it is crucial to maintain accountability for any unverified data used in legal decisions. The court has tasked the Bar Council of India (BCI) with assisting in this endeavor and has sought input from Attorney General R Venkataramani and senior advocate Shyam Divan, who is acting as amicus curiae. The court aims to examine the implications of AI-generated judgments and ensure that such practices do not undermine public trust in the judicial system. A report from a committee of experts in AI is expected to be submitted to the court later this month, as the issue continues to evolve.
