On Wednesday, the Supreme Court of India directed the Bar Council of India to form a committee of experts to examine the risks associated with artificial intelligence (AI) in court proceedings. The court highlighted the importance of accountability in judicial processes, particularly in light of instances where judges may rely on non-existent judgments generated by AI. Senior Advocate Shyam Divan, serving as amicus curiae, noted that the Supreme Court's Centre for Research and Planning has already prepared a white paper outlining recommendations for AI use in the judiciary. The bench, comprising Justices P S Narasimha and Alok Aradhe, underscored that reliance on AI-generated materials could lead to legal consequences, classifying it as misconduct rather than mere judicial error.
