The Supreme Court of India has issued a directive emphasizing the need for trial courts to consider mitigating factors in potential death penalty cases. In an order dated April 27, a bench comprising Justices Vikram Nath, Sandeep Mehta, and Vijay Bishnoi mandated that trial courts must call for reports on aggravating and mitigating circumstances immediately after a conviction, prior to sentencing. If such reports are not obtained, High Courts are required to request them during the death reference stage. The court highlighted that the absence of structured guidelines and inadequate prison reforms have hindered effective rehabilitation and timely sentencing. Furthermore, the ruling addresses the issue of inadequate legal representation for convicts facing death sentences, mandating that dedicated legal teams be assigned to ensure proper defense, regardless of whether the convict has private counsel. This comprehensive approach aims to facilitate a balanced and informed sentencing process, ultimately promoting justice and reformative principles within the judicial system.
