Kishore Datta, the Advocate General of West Bengal, submitted his resignation on Tuesday, following the Bharatiya Janata Party's (BJP) historic victory in the state Assembly elections. The BJP won 206 seats, achieving a majority for the first time in West Bengal's history, while the ruling Trinamool Congress (TMC) was reduced to 81 seats. Although there is no legal requirement for the Advocate General to resign during a regime change, it is customary for the state's top legal officer to step down when a new government is elected. Datta's resignation follows his second term, which began in December 2023, after he succeeded Soumendranath Mukhopadhyay. He had previously resigned in September 2021, citing personal reasons. His tenure included representation in significant cases, such as the Narada sting operation and post-poll violence litigation. The appointment of a new Advocate General will commence once the BJP-led Cabinet is sworn in. Meanwhile, Chief Minister Mamata Banerjee maintained her stance that her party had not been defeated and refused to resign, asserting, “We have not been defeated. I will not resign.”
