This ruling, delivered by Justice Alok Mathur and Justice Amitabh Kumar Rai, allows KGMU to proceed with its plans to construct a patient utility centre on the site. The petition was filed by Syed Babar Islam, who argued for the land's transfer, including areas from which encroachments had been removed. The court, however, stated that the petitioners could seek remedies under the Waqf Act, 1995, and therefore dismissed the case as lacking merit. The land, located behind the ophthalmology department, had been the subject of disputes following KGMU's removal of unauthorized encroachments in 2025.
