On Monday, the Supreme Court of India, led by Chief Justice Surya Kant and Justice Joymalya Bagchi, ruled that the issuance of new Aadhaar cards should be restricted to citizens aged six years and below, necessitating legislative intervention. The court was addressing a public interest litigation filed by lawyer Ashwini Upadhyay, which sought to prevent infiltrators from misrepresenting themselves as Indian citizens by obtaining Aadhaar cards. The petitioner highlighted that the Unique Identification Authority of India (UIDAI) has issued 144 crore Aadhaar cards, with approximately 99% of the Indian population enrolled. The court advised that the petitioner should present these concerns to the Union government and relevant stakeholders for appropriate action. The bench noted that many of the requested changes would require amendments to existing laws, and they disposed of the petition, treating it as a representation instead. The plea raised significant legal questions regarding the Aadhaar Act of 2016, particularly its effectiveness in distinguishing between foreign nationals and Indian citizens, as well as concerns about the misuse of Aadhaar undermining welfare delivery.
