The Uttar Pradesh government has made a significant commitment to ensure that no person will be arrested without being informed of the reasons for their arrest. This assurance was provided to the Lucknow bench of the Allahabad High Court during a recent hearing. The court allowed a habeas corpus petition filed by the nephew of Santosh Gupta, who was arrested under allegations of fraud and forgery in Balrampur district. The court found Gupta's arrest to be wrongful, as he was not informed of the grounds for his arrest, violating Supreme Court guidelines established in the Mihir Rajesh Shah case. Following this ruling, Additional Advocate General Vinod Kumar Shahi assured the court that future arrests would strictly comply with the provisions of the Bharatiya Nagrik Suraksha Sanhita (BNSS), 2023, and that all necessary measures would be taken to prevent arbitrary arrests in the state.
