On Thursday, the Supreme Court of India, led by Chief Justice Surya Kant and Justice Joymalya Bagchi, sought a response from the Centre regarding a Public Interest Litigation (PIL) that calls for the establishment of a revenue judicial service. The petition, filed by advocate Ashwini Upadhyay, asserts that nearly 66% of civil cases pertain to land disputes, which are currently adjudicated by revenue officers who lack formal legal education and training. This situation has resulted in arbitrary and inconsistent decisions, causing prolonged uncertainty over property rights and infringing upon citizens' fundamental rights under Articles 14 and 21 of the Indian Constitution. The petition also highlights that previous directions from the Allahabad High Court on this matter have not been effectively implemented. It urges the Centre and states to set minimum legal qualifications and a judicial training module for revenue officers, as well as to ensure that adjudications related to property rights are supervised by the respective high courts.
