Kabir Chauhan and Brindra Chauhan, residents of Chandigarh, have been waiting for over six years for possession of their 3BHK apartment in Omaxe's 'The Lake' project in New Chandigarh. After filing a complaint, the Punjab Real Estate Regulatory Authority (RERA) directed the developer, Omaxe Chandigarh Extension Developers Pvt Ltd, to pay ₹54 lakh in delay interest at 10.80% per annum and to hand over possession once completion and occupation certificates are obtained. The couple booked the flat in 2014, paying over ₹70 lakh, yet they never received possession by the promised date of March 2019. They also claimed that the developer charged them based on 'super area' rather than 'carpet area', alleging they were overcharged by nearly ₹25.84 lakh. While Omaxe contested these claims, arguing that the buyers understood the pricing structure, RERA rejected the developer's justification of Covid-19 related delays, stating that possession was due before the pandemic. The authority ordered interest payments on the amount deposited by the buyers from March 21, 2019, until actual possession is granted.
