The Centre has implemented the Assam Tenancy Act, 2021, in Chandigarh, aiming to overhaul the rental landscape by introducing substantial penalties for tenants who overstay their lease. Under the new law, tenants can incur penalties of double the monthly rent for the first two months and four times the rent thereafter if they do not vacate on time. This means that a tenant paying ₹20,000 monthly could face charges of ₹40,000 initially and ₹80,000 subsequently until they leave. Additionally, the law mandates that all rental agreements must be in writing and submitted to the Rent Authority within two months. Security deposits are capped at two months' rent for residential properties and six months for commercial ones. The Act also establishes a three-tier dispute resolution system to expedite the handling of rental disputes. Importantly, while the new Act replaces the East Punjab Urban Rent Restriction Act, 1949, all pending cases under the old law will continue to be adjudicated according to its provisions.
