On Thursday, the Supreme Court of India urged the central government to amend existing laws to remove gestational time restrictions for rape survivors seeking abortions. This recommendation arose during a hearing of a curative plea from the All India Institute of Medical Sciences (AIIMS), which sought to reconsider the court's earlier decision to allow a 15-year-old girl to terminate her pregnancy at over 30 weeks. Chief Justice of India Surya Kant emphasized the need for legal frameworks to evolve and prioritize the dignity of rape survivors, stating that unwanted pregnancies should not be forced upon women, particularly minors. The court had previously allowed the minor to terminate her pregnancy, but AIIMS expressed concerns that such a procedure could result in severe deformities and long-term health risks for the girl. The bench underscored that the decision should ultimately lie with the minor and her parents, advocating for counseling to ensure informed choices. Justice Joymalya Bagchi reinforced the importance of respecting individual choices and preventing adversarial situations between the state and citizens.
