On Thursday, the Supreme Court of India dismissed a plea challenging the Election Commission of India's (ECI) orders to transfer senior police officers and bureaucrats in West Bengal in preparation for the 2026 Assembly elections. The three-member bench, led by Chief Justice of India Surya Kant, stated that such transfers are not uncommon. However, the court acknowledged the petitioner's valid concern regarding the ECI's failure to consult the state government before making these transfers. Despite recognizing this issue, the court opted not to intervene at this time, leaving the legal question open for future deliberation. This decision came during the hearing of an appeal against a ruling from the Calcutta High Court, which had previously upheld the ECI's transfers, noting that replacements for the transferred officials were already in place. The High Court also declined to address the impeachment proceedings initiated against Chief Election Commissioner Gyanesh Kumar, as no direct link between the transfers and the impeachment motion was demonstrated.
