On Wednesday, the Supreme Court of India intervened by staying a Madras High Court order that barred R Sreenivasa Sethupathi, a Member of the Legislative Assembly representing the Tamilaga Vettri Kazhagam (TVK) party, from participating in the floor test of the Tamil Nadu Legislative Assembly. The Madras High Court's decision had restricted Sethupathi from voting or engaging in any proceedings that would test the numerical strength of the Assembly. The Supreme Court bench, comprising Justices Vikram Nath, Sandeep Mehta, and Vijay Bishnoi, criticized the high court for entertaining an Article 226 petition despite stating that the appropriate remedy was an election petition. The court has granted a two-week period for K R Periakaruppan, Sethupathi's opponent from the Dravida Munnetra Kazhagam (DMK) party, to file a counter affidavit regarding Sethupathi's challenge. Notably, Sethupathi won the No.185 Tiruppattur assembly constituency in Sivagangai district by a mere single vote. Meanwhile, the TVK government successfully secured a vote of confidence in the assembly on the same day.
