In a significant ruling, a special court in Mumbai has convicted a 42-year-old man for aggravated sexual assault against a four-year-old girl, sentencing him to five years of rigorous imprisonment. The incident, which occurred in July 2023, involved the accused, known as 'Mama' to the family, allegedly assaulting the child while she was alone at home with her younger sibling. Although the court found the child’s testimony credible, it acquitted the man of rape and penetrative sexual assault charges due to a lack of medical evidence indicating penetration. The court noted that the medical examination revealed no injuries, and the judge stated, “The evidence is not sufficient to prove the fact of penetrative sexual assault.” A fine of ₹10,000 was imposed, with ₹8,000 allocated for the victim's compensation. The court emphasized that the accused exploited the child's vulnerability, causing her mental trauma.
