The Delhi High Court has rescheduled the hearing of the Enforcement Directorate's (ED) appeal in the National Herald case to May 25. The decision comes after the court, led by Justice Swarna Kanta Sharma, determined that there was not enough time to hear detailed arguments on the matter. Senior Advocates Kapil Sibal and Abhishek Manu Singhvi represented the respondents, including Congress leaders Sonia Gandhi and Rahul Gandhi, while Additional Solicitor General S.V. Raju and ED counsel Zoheb Hossain were present for the ED. The appeal challenges a decision from the Rouse Avenue Court, which had declined to recognize the ED's prosecution complaint under the Prevention of Money Laundering Act (PMLA). The ED argues that the trial court erred by stating that proceedings cannot continue without a First Information Report (FIR) in the scheduled offence, asserting that such a requirement does not apply when cognizance has already been taken of a private complaint.
