In a significant ruling, the Supreme Court of India has refused to stay the implementation of Adani Enterprises' ₹14,500 crore resolution plan for Jaiprakash Associates Ltd., a company facing insolvency with debts exceeding ₹57,000 crore. Chief Justice Surya Kant led the bench, which noted that the insolvency proceedings are scheduled for a final hearing before the National Company Law Appellate Tribunal (NCLAT) on April 10, 2024. Vedanta Group challenged the decision, claiming that the process lacked transparency and that their higher bid of ₹16,726 crore was unjustly overlooked. However, the lenders defended their choice, emphasizing that resolution plans consider various factors beyond just the highest financial offer, including upfront payments and repayment timelines. Adani's plan was favored due to a ₹6,000 crore upfront payment and a two-year repayment schedule. The NCLAT had previously allowed the insolvency process to continue, seeking responses from stakeholders. The proposed acquisition has also received approval from the Competition Commission of India, as mandated by the Competition Act, 2002.
