The Gujarat High Court has determined that the Employee State Insurance Corporation (ESIC) is not responsible for compensating the family of Raman Patel, who died from a heart attack while working at Bajaj Processors in Gujarat on September 9, 2004. Patel, a fitter mechanic, experienced chest and abdominal pain during his shift and was taken to a hospital where he later died. The post-mortem report indicated that his death was due to cardiorespiratory arrest caused by coronary heart disease. Initially, the ESI court ruled in December 2010 that Patel's family was entitled to dependency benefits, but ESIC contested this decision. During the appeal, ESIC's advocate, Sachin Vasavada, argued that a heart attack does not qualify as an employment injury under Section 2(8) of the ESI Act. The High Court agreed, stating that there was no evidence to establish a link between the death and employment-related stress or conditions. Justice J C Doshi highlighted that without proof of a connection between the occupational disease and the death, the ESI Act does not provide for dependency benefits.
