Higgins contends that a full blood test would show a BAC of 0.075, which is below the threshold for intoxication. The defense claims that this misrepresentation undermined the integrity of the grand jury process and demands that the charges against Higgins be dismissed or reduced. If convicted, Higgins faces a maximum sentence of 70 years in prison. A court date is set for May 11, 2024 to address these claims.
