The US government is preparing to launch the Consolidated Administration and Processing of Entries (CAPE) portal on April 20. This online platform will enable businesses to apply for refunds on tariffs deemed illegal by the US Supreme Court, which ruled that tariffs under the International Emergency Economic Powers Act (IEEPA) were unlawful. The ruling could leave the government liable for up to $175 billion in refunds. Eligible claimants include businesses that paid IEEPA tariffs and customs brokers acting on their behalf, while consumers are excluded from applying. Refunds will not be issued automatically; companies must submit claims through the CAPE portal and provide necessary bank account information via the ACE Portal. Once a claim is accepted, refunds are expected to be processed within 60 to 90 days, unless further review is needed. Payments will be made electronically through the Automated Clearing House (ACH), requiring the claimant's bank information to be on file with US Customs and Border Protection (CBP).
