The National Company Law Tribunal (NCLT) has permitted the withdrawal of corporate insolvency resolution proceedings (CIRP) against Nobility Estates Private Limited (NEPL), a subsidiary of the ATS Group, concerning its luxury housing project, Le Grandiose, in Noida, Uttar Pradesh, India. This decision, made on May 5, follows a settlement reached with lenders under Section 12A of the Insolvency and Bankruptcy Code (IBC). The insolvency proceedings were initiated by ASK Property Investment Advisors Private Limited due to alleged defaults on financial obligations linked to Optionally Convertible Debentures (OCDs). The NCLT had admitted the application on November 24, 2023, leading to the appointment of an interim resolution professional. As part of the settlement, NEPL has agreed to pay ₹108 crore against a total liability of ₹775 crore. The company is also required to revalidate its sanctioned map and renew its RERA licence within 120 days of the settlement approval, and to complete construction of Phase II within 48 months. The settlement received overwhelming support from the Committee of Creditors, with more than 92% voting in favor, exceeding the 90% threshold required. This development is significant for ATS Group, which has been focusing on enhancing its financial performance and project execution.
