The Western Cape High Court has upheld a lower court's decision dismissing a husband's appeal for ownership of a Suzuki Jimny he had gifted to his wife. The dispute arose from a December 2021 agreement, which stated that the wife would retain ownership unless they separated before the finance agreement was settled. Following their marriage in March 2022, the husband refinanced the vehicle in August 2023, settling the previous debt with MFC Nedbank. However, the marriage deteriorated, leading to the wife obtaining a protection order against the husband. When the husband sought ownership after the wife temporarily left their home, the lower court found he failed to prove a separation occurred under the terms of their agreement. On appeal, the court noted that the husband had not requested oral evidence and criticized his inadequate responses to the wife's claims regarding her safety. Ultimately, the court ruled that ownership of the vehicle remained with the wife, dismissing the husband's appeal entirely.
