On Wednesday, the Supreme Court of India stated that while it can draw attention to the need for legislative action regarding hate speech, it lacks the authority to compel the legislature to enact new laws. A bench comprising Justices Vikram Nath and Sandeep Mehta noted that there is no legislative vacuum, as the current legal framework adequately addresses hate speech. The court observed that the real issue lies in the inconsistent application of existing laws rather than a lack of legislation. It reiterated that the legislature has the discretion to act upon the court's recommendations. The bench emphasized the importance of freedom of speech under Article 19(1)(a) of the Constitution, while also acknowledging that this freedom is not absolute and can be restricted in the interest of public order and harmony. The court dismissed several petitions related to hate speech and closed contempt petitions against state authorities for non-compliance with its earlier directives.
