On Tuesday, the Supreme Court of India suspended a Look-Out Circular (LOC) issued by the Central Bureau of Investigation (CBI) against businessman Nimesh Shah. The court's decision came after Shah was stopped at Mumbai airport despite having received permission from a special court to travel abroad. Justices Vikram Nath and Sandeep Mehta highlighted that LOCs are administrative alerts and should not operate without disclosure of reasons. The court has directed the Ministry of Home Affairs to respond regarding the authority to issue such orders. Shah's legal troubles stem from allegations that his company caused a loss of ₹464 crore (approximately $56 million USD) to banks by inflating financials. The LOC was issued without Shah's prior knowledge, raising concerns about the procedural safeguards surrounding its issuance. The court noted that while LOCs are meant to ensure a person's presence for legal proceedings, their use must remain constitutionally valid and respect the fundamental right to travel abroad as enshrined in Article 21 of the Indian Constitution.
