The Jammu and Kashmir and Ladakh High Court has ordered the State Bank of India (SBI) to grant a family pension to the daughter of a deceased employee, dismissing the bank's 'hyper-technical' objections regarding her eligibility. The division bench, comprising Justices Sanjeev Kumar and Sanjay Parihar, addressed a petition from SBI challenging a previous ruling that had favored the daughter. The employee, who passed away in 2010, had retired in 1994 and had failed to mention his daughter's name in the pension declaration form, leading to the bank's initial denial of the claim. The court, however, found that the daughter, who has been physically disabled since 1975, meets all eligibility criteria under Rule 23 of the Pensionary Regulations. The ruling underscores the need for banks to consider the unique circumstances of applicants rather than relying solely on technicalities in documentation. The court emphasized that the daughter's lifelong disability should not disqualify her from receiving the pension intended for dependents of deceased employees.
