The Income Tax Department of India has filed an appeal with the Supreme Court challenging a decision from the Delhi High Court regarding Genpact Consulting Singapore Pte's income tax assessment for the financial year 2014-15. The department alleges that the sale of 1,486,025 equity shares from Genpact India to its wholly owned subsidiary was part of a broader scheme to avoid taxes. Specifically, it claims that Genpact India aimed to evade the dividend distribution tax under Section 115-O of the Income Tax Act. The case will be heard by a bench led by Chief Justice Surya Kant next week. Previously, the Assessing Officer had accepted Genpact's argument that the transaction fell under an exemption in Section 47(O) of the Income Tax Act, thus not qualifying as a transfer for capital gains computation.
