Disney is preparing to challenge an unusual broadcast license review mandated by the Federal Communications Commission (FCC), as legal experts assert that the company has strong legal grounds. The 1996 Telecommunications Act made it significantly more difficult for the FCC to revoke or deny the renewal of broadcast licenses. According to Andrew Jay Schwartzman, a senior counselor at the Benton Institute for Broadband & Society, the amendment introduced by the National Association of Broadcasters has created a high barrier for the FCC in such cases. Northwestern University law professor James Speta noted that the Act requires the FCC to provide substantial evidence of 'willful or repeated' violations before taking any action against a licensee. The FCC has instructed Disney to submit early license renewal applications for all its television stations by May 28, a directive issued shortly after Trump and Melania Trump called for ABC to terminate Jimmy Kimmel due to a controversial joke he made about Melania. This political pressure adds another layer to Disney's legal battle with the FCC.
