The arrest was mandated by the Bulacan Regional Trial Court Branch 20, which cited Discaya for falsifying public funds or property. His charges are non-bailable, adding to his legal troubles as he has been in Senate custody since September 2025 after being found in contempt during a Senate blue ribbon committee hearing investigating an infrastructure scam. Despite undergoing shoulder surgery while in custody, Discaya was returned to the Senate facilities shortly after.
