The Punjab and Haryana High Court has ordered the governments of Punjab and Haryana to notify rules for the implementation of the Mental Healthcare Act, 2017, within 15 days. The court, led by Chief Justice Sheel Nagu and Justice Sanjiv Berry, expressed frustration over the lengthy delays in formulating these rules, which are essential for providing mental healthcare services across both states. The Act mandates the availability of basic and emergency mental healthcare services, the establishment of halfway homes, and educational programs for individuals with mental illness. Despite the law being in effect for eight years, little progress has been made, with only the Union Territory of Chandigarh providing a group home. The court also directed the Postgraduate Institute of Medical Education and Research (PGIMER) in Chandigarh to report on a survey for group homes in Punjab, while seeking similar updates from AIIMS, New Delhi regarding Haryana. Furthermore, the court has given Haryana five weeks to establish a mental health board as required by the Act.
