The Delhi High Court has granted an ex parte ad interim injunction in favor of Aman Gupta, co-founder of boAt lifestyle and a prominent figure on 'Shark Tank India', to protect his personality rights against unauthorized exploitation through sexually explicit AI deepfakes. Justice Tushar Rao Gedela noted that the defendants were unlawfully profiting from Gupta's persona, which has gained significant recognition in both business and social media, with over three million followers on LinkedIn and 1.7 million on Instagram. The court's order, issued on May 7, highlights the urgent need to address the misuse of personality traits and attributes, especially in the context of digital media. Gupta's legal team argued that the unauthorized commercial use of his name, image, and slogans not only dilutes his brand but also causes irreparable harm to his reputation and financial interests. The court's findings underscore the necessity of protecting personality rights in an era where digital misappropriation can lead to significant financial exploitation.
