Justice Jitendra Jain criticized the Railway Claims Tribunal for its failure to consider vital evidence, including eyewitness accounts that confirmed the fall was accidental. The court has mandated a compensation of ₹4 lakh (approximately $4,800 USD) with an annual interest of 6% from the date of the incident, although the total payout is capped at ₹8 lakh. The victim, who fell while traveling towards Churchgate, succumbed to his injuries within six hours. Initially, the tribunal denied compensation, claiming the deceased was not a bona fide passenger and that the incident did not qualify as an “untoward incident” under the Railways Act. This conclusion was overturned by the High Court, which found that the victim had valid tickets from Goregaon to Churchgate. Furthermore, Western Railway's argument that the victim was trespassing was dismissed due to insufficient evidence. The court emphasized the need for accurate documentation of train movements, especially since the body was discovered near Platform 3.
